JUDGMENT / ORDER

Petition filed under Section 439(1) Cr.P.C. read with Section 41A Abkari Act. 2. Petitioner is the 1st accused in Crime No.1 of 2014 of Kayamkulam Excise Range registered for the offences under Sections 8(1)(2) and 67B of the Abkari Act.
3. The prosecution allegation is that on 1.1.2014 at about 9 a.m the petitioner was found to be in possession of 2.5 litres of arrack. He was transporting it in an autorickshaw, the driver of which was the second accused. He would submit that he is innocent.
4. Heard the learned counsel for the petitioner and the learned Public Prosecutor.
5. The investigation is over and the case is pending trial in the court concerned as SC No.242 of 2014. Sale of arrack is a very serious offence. The petitioner is only 27 years old. If he is released on bail, he may intimidate the witnesses or attempt to influence them or he may abscond. It is not proper to grant him bail though the case is ripe for trial.
In the result, this application is dismissed.
