Heard learned counsel for the applicant, and learned A.G.A. for the State.
This bail application has been moved by the accused-applicant Udayveer who is involved in Case Crime No. 321/2017, under Sections 304 I.P.C., Police Station- Mangalpur, District Kanpur Dehat.
As per prosecution version, on 12.07.2017 at about 5:00 a.m. appellant and co- accused Shoshit Kumar administered medical treatment to Pankaj, son of Ramnath (informant). Later on, they went away. Informant took his son to Derapur for treatment but his son was referred to district hospital and on the way he died.
It is contended by learned counsel for the applicant that applicant has been falsely implicated in the present case. No offence is made out under Section 304 I.P.C. It is further contended that deceased died due to Septicaemia. Applicant has no criminal history.
Learned A.G.A. has opposed the prayer for bail.
As per postmortem report, deceased died due to Septicaemia.
Considering the facts and circumstances of the case and without expressing any opinion on the merit, I find it a fit case for enlarging the applicant on bail.
Let the applicant Udayveer be released on bail in the aforesaid case crime number on furnishing a personal bond and two reliable sureties of the like amount to the satisfaction of the Magistrate/court concerned.
Accordingly bail application is allowed. Order Date :- 27.2.2018 Sharad/-
