----------------------- The petitioner is the holder of the Indian Passport bearing No.E5827466, The petitioner submits that the date of birth shown in the Passport is 10.8.1958 instead of 1.6.1964. The petitioner has approached the Passport authorities for correcting the date of birth in his Passport. The Passport Authorities refused to act upon the request of the petitioner. Accordingly the petitioner approached this Court.
2. In Nizar Vs.Union of India [2014 (4) KLT 609], this Court held that if the disparity is more than two years, the Passport Authorities have power to correct the Passport. In view of the above, Passport authorities have power to correct the details regarding the entry in the Passport provided the petitioner establishes the genuiness of the claim.
3. Considering the facts and circumstances, there shall be a direction to the 2nd respondent to consider the request of the W.P.(C).No.30414 of 2014

petitioner to correct the date of entry in the Passport on being satisfied with the genuineness of the claim of the petitioner and shall take appropriate action in accordance with law within a period of four weeks from the date of receipt of a copy of this judgment.
The writ petition is disposed of as above.
