Heard learned counsel for the petitioner and the learned Standing Counsel.
The petitioner, who retired on 31 January 2018, has preferred the instant writ petition seeking the retiral and pensionary benefits including benefits of ACP.
It appears that although the petitioner was initially appointed against a work charge establishment, on 12 January 2007 he was selected for appointment in the regular establishment. According to learned counsel the petitioner was, in fact, thereafter absorbed in the regular establishment of the respondents. However, presently there is no order of absorption or regularisation on record.
Learned Standing Counsel submits that subject to all contentions on merits being left open, the fourth respondent shall duly evaluate the claim of the petitioner and pass a reasoned and speaking order dealing with the same within a period of three months from the date of presentation of a certified copy of this order.
Accordingly and without going into the merits of the claim of the petitioner, this petition shall stand disposed of in light of the statement noted above.
