The prayer made in the instant petition is for issuance of a direction to the court below to expedite the proceedings of Original Suit No.839 of 2002.
By various orders, comments were called from the Presiding Officer in respect of delay in disposal of the suit.
Civil Judge (Junior Division), Sri Manoj Kumar Yadav has sent his comment dated 29.8.2019, according to which he took charge as Civil Judge (Junior Division) on 16.4.2019. He remained on training from 1.5.2019 to 31.7.2019. He started working since 1.8.2019. He has given assurance to this Court that he will make all endeavour to decide the suit expeditiously within three months.
Accordingly, the petition is disposed of by providing that all endeavour should be made to decide the suit expeditiously by fixing short dates. As assured by the Presiding Officer, he should decide the suit as far as possible within three months.
