Sri Bhrigue Jee Singh, learned counsel for the petitioner, Sri Bhupendra Kumar Tripathi for respondent no. 5 and learned Standing Counsel for the State.
Counsel for the petitioner submits that respondent no. 2, Sub Divisional Officer, District Ballia be directed to decide Suit No. 811 of 2016 (Computerized Suit No. T 2016150903811) under Section 116 of Uttar Pradesh Revenue Code, 2006, Mauza Parikhara, Pargana and District Ballia within a stipulate time.
This prayer is not opposed by the learned Standing counsel.
In view of such facts, the writ petition can be disposed of with a direction to respondent no. 2, to decide the aforesaid suit of the petitioner on its own merits, if possible, within a period of 90 days from the date of receipt of computer generated copy of the order being passed today in PDF form strictly in accordance with law.
In above terms, the writ petition is disposed of.
It is made clear that this Court has not expressed any opinion on the merits of the case.
