JUDGMENT / ORDER

(PER : HONOURABLE MR.JUSTICE VIJAY MANOHAR SAHAI) 1. We have heard Mr.S.H.Bhatt, learned advocate for the appellant and Mr.Rakesh R.Patel, learned A.G.P. for respondent No.1.
2. This Letters Patent Appeal has been filed challenging the judgment dated 17.10.2012 passed by the learned Single Judge in Special Civil Application No.13980 of 2012.
3. The case of the appellant is that on 14.7.2000, the appellant applied for the post of Driver. That after interview and practical test, his name was included in the select list. But, the appellant was not appointed. The letter issued by the District Judge, Banaskantha at Palanpur dated 20.8.2001 clearly mentions that in pursuance of the post, five candidates have been selected, who shall be considered for appointment as and when vacancy arises. It is not on record that when the selection took place, how many vacancies were available for making appointment on the post of Driver. Be it as it may. The High Court has taken a decision to conduct Centralised Examination for the posts of Driver, Peon and other Class III posts in the entire State of Gujarat and, therefore, the advertisement was issued for making selection. The claim of the appellant is that the advertisement shows that there are vacancies of Drivers and he ought to have been appointed as he was selected in the year 2001. We are of the opinion that life of the select list cannot be 10 years, at the most it is for one year, and further, if at the time of recruitment, any advertisement was issued and vacancies were advertised, no further vacancies could be filled or waiting list, if any, could be given effect for the aforesaid reasons since fresh advertisement has been issued by the High Court in the year 2012.
4. We do not find any merits in the appeal or illegality in the impugned order passed by the learned Single Judge. This appeal is devoid of any merits and is accordingly dismissed.
