Heard learned counsel for the applicant, learned A.G.A. and perused the record.
Learned counsel for the applicant contended that this is a matrimonial dispute. The applicant is father-in-law of the informant. The family member of the applicant filed Criminal Misc. Writ Petition No. 8315 of 2010 before this Hon'ble Court against the first information report which was lodged by the informant. This Hon'ble Court stayed the arrest of the family members of the applicant on 17.5.2010 and matter referred to Mediation Centre. The applicant is in jail since 5.5.2010.
Considering the aforesaid facts, without observation on merit it is a fit case for bail. Let the applicant, Udaiveer Singh Saxena involved in Case Crime No.175 of 2010, under Sections 498-A, 323, 504, 506, 328, 313 I.P.C. and 3/4 D.P. Act, P.S. Bilari, District Moradabad be released on bail on his furnishing a personal bond and two sureties each in the like amount to the satisfaction of the Court concerned.
