The present criminal revision has been filed to quash the order dated 16.05.2018 passed by the Session Judge, Firozabad in Session Trial No. 427 of 2016 (State Vs. Vijay & Veetu @ Manoj), arising out of Case Crime No. 151 of 2015, under Sections- 147, 148, 307/141 I.P.C., Police Station- Eka, District- Firozabad, by which the learned Court below has rejected the application filed by the present applicant under Section 319 Cr.P.C.
While the order impugned appears to be reasoned, it is however, made clear that in the event any further evidence is led and necessary evidence thus arises as to implicate any other person as an accused, it shall remain open to the prosecution to make a fresh application which may be decided on its own merit without being prejudiced by any observation made in the impugned order.
With the aforesaid observation, the present criminal revision is disposed of.
