Present writ petition has been filed under Article 226 of the Constitution of India for a writ of certiorari quashing the impugned voter list for the year 2009 as well as the entire U.P. Panchayat Raj(Disposal of Election Affairs) Rules, 1994.
It is settled law that there shall be a presumption with regard to constitutional validity of the statute or enactment. Nothing has been pleaded as to how the rules in question are unconstitutional.
So far as the cancellation of votors list is concerned, already election has been held and whenever fresh election is held, the petitioner will get right to represent his cause before the appropriate authority.
The writ petition seems to be mis-conceived. It is accordingly dismissed. No order as to costs.
