Heard learned counsel for the petitioners and learned AGA. Shri Gyan Prakash learned Senior Counsel assisted by Shri Sanjay Kumar Yadav appears for the Central Bureau of Investigation (CBI).
Present writ petition has been preferred for a direction to respondents not to adopt any coercive method against the petitioners pursuant to FIR dated 12.02.2021 in Case Crime No.38 of 2021 under Section 302, 394, 452, 504 IPC, P.S. Baksa, Distt. Jaunpur.
On the matter being taken up today, learned counsel for CBI on the basis of instructions dated 15.12.2021 has apprised to the Court that the petitioners are family members of the accused Ajay Kumar Singh. Since the accused Ajay Kumar Singh was absconding and NBW was issued against him, efforts were being made to trace him by visiting his parental home in the village in which the petitioners are reside. The allegations of harassing the petitioners are ill founded and baseless. It is further informed that since the accused Ajay Kumar Singh has surrendered and is presently in judicial custody, there is no further occasion of visiting his parental house any more. As such it is contended that the reliefs claimed in the writ petition no more survive.
The Court has proceeded to examine the record in question and find that once categorical instructions have been produced by CBI, no further direction is required to be passed in the matter.
The writ petition stands disposed of accordingly.
