ORDER:
Heard the learned counsel appearing for the petitioner and the learned counsel appearing for the respondents.
This writ petition is filed under Article 226 of the Constitution of India seeking a Writ of Mandamus declaring the action of the 2nd respondent in directing the petitioner to maintain status quo until disposal of the issue before him vide his proceedings No.B/532/2014, dated 28.03.2014 as arbitrary, illegal, unjustified and in violation of the provisions of the Industrial Disputes Act, 1947.
The Conciliation Officer & Joint Commissioner of Labour issued the proceedings directing the petitioner management to maintain status quo until the disposal of the issue before the Joint Commissioner of Labour, Hyderabad (Twin Cities). Now the learned counsel appearing for the respondents submitted that the Conciliation Officer after conducting the conciliation submitted the report under Section 12(4) of the Industrial Disputes Act, 1947 stating that the conciliation failed and the issues are referred for adjudication.
In view of the report submitted by the Conciliation Officer, nothing survives for adjudication in the present writ petition. Therefore, the Writ Petition is dismissed as having become infructuous. No order as to costs.
Pending miscellaneous petitions, if any, shall stand closed in consequence.
