Heard learned counsel for the applicant and learned AGA for the State.
Present application U/s 482 Cr.P.C has been filed to quash the impugned order dated 28.02.2019 passed by Incharge Session Judge, Fatehpur in S.T. No.418 of 2013 (State Vs. Udai Bhan Singh and others), arising out of Case Crime No.58 of 2000, U/S 147, 148, 149, 307, 504, 506 I.P.C, Police Station Bakewar, District Fatehpur.
The apprehension of the applicant is that in pursuance of the bail order dated 28.02.2019 granting him bail he has been directed to deposit Rs.10,000/-. His apprehension is that in case he is acquitted in trial the aforesaid amount shall not be returned back to him.
This application is disposed of directing the court below to ensure that in case of acquittal of the applicant this amount shall be refunded to him. Further in case aforesaid amount has not been released in favour of the informant, the same shall be invested in Nationalised bank during the pendency of trial and after the trial is concluded and the trial court shall decide, to whom this amount is to be given along with accrued interest.
