JUDGMENT / ORDER

The petitioners herein are the three accused in C.C. No.1116/2013 of the Judicial First Class Magistrate Court I, Manjeri. Crime in the said case was registered under Sections 143, 147, 341, and 323 r/w Section 149 of the Indian Penal Code on the complaint of one Noufal. The said Noufal is the 2nd respondent in this proceeding. The petitioners now seek orders quashing the prosecution on the ground that they and the complainant have amicably settled the whole dispute out of court. Respondents 3 and 4 are the other persons, who sustained injuries in the alleged incident of assault. Respondents 2 to 4 have filed affidavit to the effect that they have settled the whole dispute amicably with the accused, and that they have no complaint or grievance now. In fact the main offence is compoundable. But orders under Section 482 of the Code of Criminal Procedure are sought because the other offences are not compoundable under the law. I find that the parties have really settled the whole dispute, and now they are Crl.M.C No.6563 of 2014 2 on cordial terms.
In the result, this Criminal Miscellaneous Case is allowed. The prosecution against the petitioners herein in C.C No.1116/2013 before the Judicial First Class Magistrate Court-I, Manjeri will stand quashed under Section 482 of the Code of Criminal Procedure, and the petitioners will stand released from prosecution. The bail bond, if any, executed by the petitioners will stand discharged.
