The petitioner’s vehicle bearing registration No.KL-7-Y- 3321 has been seized alleging transportation of river sand without permit. By Ext.P4, the sand in the vehicle is identified as ‘crushed weathered rock’. The petitioner has expressed his willingness to compound the offence.
In view of the above, the only offence that would lie against the petitioner under the Minor Mineral Concession Rules. Therefore, there shall be a direction to the first respondent to compound the offence on payment of Rs.25,000/- (Rupees twenty five thousand only) in terms of Rule 60 A (1) of the Minor Mineral Concession Rules. On payment of the above amount, the vehicle shall be released to W.P.(C) No.30894 of 2014 2 the petitioner within three days. The first respondent shall also report the composition of the offence before the Judicial First Class Magistrate-1, Ernakulam.
The writ petition is disposed of as above.
