Heard learned counsel for the petitioner, learned Standing Counsel for respondent nos.1 to 3 and Sri Chandan Agarwal, learned counsel for respondent nos.4 to 7.
The daughter of the petitioner Shalini Gupta was working as Assistant Teacher in Primary School, Bichaula, District Badaun on 04.12.1999. She died on 28.08.2018. The petitioner being heir of late Shalini Gupta submitted application for payment of GPF and benefit of Group Insurance Scheme.
The grievance of the petitioner is that the respondent no.5 has not issued any order for payment of GPF and benefit of Group Insurance Scheme to the petitioner.
Learned counsel for the respondent nos.4 to 7 submits that no useful purpose would be served in keeping the writ petition pending, and an appropriate direction be issued to respondent no.5 to consider the grievance of the petitioner.
Considering the facts and circumstances of the case, without going into merits of the case and with the consent of the parties, the writ petition is disposed of with direction to the petitioner to file a fresh representation before the respondent no.5-District Basic Education Officer, Badaun raising all her grievances within a period of three weeks from today. In case any such representation is filed, the respondent no.5 shall consider and decide the same by a reasoned and speaking order within a period of two months thereafter.
With the aforesaid observations, the writ petition is disposed off.
