Learned counsel for the respondents points out that the instant petition is no more maintainable inasmuch as the plaint of the suit out of which the instant proceedings arises stood rejected in exercise of power under Order VII Rule 11 CPC by order dated 27.07.2019. A copy of the said order has also been produced before this Court for perusal.
Shri Swapnil Kumar, learned counsel for the petition, having regard to the same very fairly prays for withdrawal of the instant petition with liberty to the petition to take such other legal measures as is permissible under law to challenge the impugned order.
The petition, accordingly, stands disposed of with liberty in terms of the prayer made.
