Heard learned counsel for the appellant.
The present appeal has been preferred by the U.P.S.R.T.C. challenging the award dated 12.02.2013 passed by the Motor Accident Claims Tribunal /Additional District Judge, Court No. 2, Moradabad.
The challenge in the present appeal is on the ground that the finding of the Tribunal in respect of involvement of the Bus No. U.P.34-C/9572 owned by the appellant is wrong and illegal and against the record.
Learned counsel for the appellant informs that another First Appeal From Order No. 4084 of 2012 arising out of the same accident has been dismissed by this Court affirming the finding of the Tribunal in respect of the involvement of the vehicle.
Consequently, the present appeal is also dismissed, in view of the judgment of this Court in First Appeal From Order No. 4084 of 2012. There shall be no order as to costs.
