This Appeal has been preferred by U.P.S.R.T.C. against the judgement and order dated 19.04.2015 passed by M.A.C. Tribunal/ Additional District Judge, Court No.5 in Claim Petition No. 817 of 2003, Smt. Phoolwati & 3 others Vs. U.P.S.R.T.C.
Appellant, U.P.S.R.T.C. being represented by Sri Ram Sagar Pandey, A.R.M. and respondent No.1 being represented through Md. Naushad Siddiqui, respondent Nos. 2 to 4 who are minors, are being represented by their natural guardian and mother i.e. respondent No.1, have filed the compromise today dated 08.09.2018 and have settled the matter on the following terms and condition:-
(1) (i) The respondent Nos. 1 to 4 shall be entitled to get Rs. 3,62,000/- (three lac sixty two thousand)+4% (four percent) interest in full and final satisfaction of their claim from appellant No.1 which has already deposited in Tribunal.
ii) The amount already deposited shall be adjusted towards the total amount due.
iii) The amount due as above shall be deposited/paid through cheque within 30 days from the date of receipt of copy of the order of the Hon'ble Court failing which interest @ 12% P.A. shall accrue from such date till payment.
2. That the respondent Nos. 2 to 4 are minors and this Appeal/FAFO is being compromised by the aforesaid minors through their natural guardian/mother, Smt. Phoolwati who is represented through her counsel mentioned above and the compromise is in the interest of the minors.
4. That the parties have compromised the appeal out of their free consent and without any coercion/pressure of any kind.
This Appeal is decided in terms of compromise which shall form part of the decree.
Office shall communicate this order to the court concerned for its immediate compliance.
