Heard Sri Santosh Kumar Tiwari, learned counsel for the petitioner and Sri Mukti Nath Dwivedi, learned counsel for the respondent.
At the out set, learned counsel for respondent Sri Mukti Nath Dwivedi on the basis of instructions submits that the petitioner has handed over the possession to the respondent, as such no cause of action survives.
The said contention has not been disputed by the counsel for the petitioner.
Accordingly, the present writ petition is dismissed as infructuous.
