Petitioner is aggrieved by an order of transfer dated 7.6.2018, whereby petitioner has been transferred from Block Ghorawal to Robertsganj.
The order is assailed on the ground that petitioner is physically disabled class IV employee and has been transferred to a distance of about 65 kilometres. Submission is that petitioner would suffer irreparable injury if she is asked to join at such a far away place. Attention of the Court has been invited to petitioner's appointment letter, as per which she was appointed in the category of physically disabled person.
Petition is opposed by learned Standing Counsel.
In the facts and circumstances, this petition stands disposed of permitting the petitioner to represent against the order of transfer before the authority concerned, highlighting her personal hardships, alongwith certified copy of this order, within a period of two weeks from today. Petitioner shall be at liberty to annex all materials in support of her claim. The authority concerned shall consider petitioner's representation, including her hardships, and take appropriate decision in the matter, within a period of two months from the date of presentation of certified copy of this order. Till a fresh decision is taken by the authority concerned upon petitioner's representation, she shall be allowed to continue at the present place of posting.
