Heard learned counsel for the parties.
Petitioner is the mother of ex-employee, a forest inspector, who committed suicide on 22 May 2015. The fifth respondent, Smt. Soni Singh, is the legally wedded wife of the ex-employee and from the wedlock the couple had borne a daughter.
It is alleged that the daughter of the ex-employe is residing with the petitioner. Petitioner opposed the appointment of the fifth respondent on compassionate ground. However, the learned counsel for the petitioner informs that the fifth respondent has been given compassionate appointment on 2 February 2019.
By the instant petition, petitioner seeks the release of pending financial benefit (GPF) of ex-employee in favour of the petitioner.
Learned Standing Counsel submits that the fourth respondent shall pass appropriate order on the representation of the petitioner in accordance with law.
In regard thereto, without entering into the merit of the case, as well as, rival contentions raised by the respective parties, it is provided that the fourth respondent, Regional Forest Officer, Tiger Reserve, District Pilibhit, shall consider and decide the grievance of the petitioner, by a reasoned and speaking order, expeditiously, preferably, within three months from the date of filing of certified copy of this order along with the copy of the writ petition. It is clarified that the fifth respondent shall also be heard before any order is passed.
With the aforementioned observations/directions, the writ petition stands disposed of.
