Hon'ble Ramesh Sinha,J. Hon'ble Ajit Kumar,J.
Case called out in the revised list. Sri Rajan Upadhyay, learned counsel for the respondent No.3 is not present.
Heard Sri Manoj Kumar Keshari, learned counsel for the petitioner, learned Standing Counsel for the State and perused the record.
By means of the present writ petition under Article 226 of the Constitution, the petitioner has prayed for a direction in the nature of mandamus commanding to the respondent No.2 to consider and decide the pending applications of the petitioner.
From the perusal of the pleadings as has come up in the writ petition as well as in the applications, it appears that the petitioner is aggrieved basically against the unauthorized possession at the end of the respondent No.4.
In such view of the matter, therefore, we find that the petitioner may seek appropriate remedy under common law. The writ petition cannot been entertained against the private individual to grant injunction.
The writ petition is, accordingly, dismissed.
