Heard counsel for the petitioner and learned Standing Counsel for respondent no. 1 as well as Shri M.M. Sahai, learned counsel appearing on behalf of respondent nos. 2 and 3.
The petitioner has preferred the present petition inter-alia with the following prayer:-
"i) issue a writ, order or direction in the nature of mandamus directing the Respondent No.3 to appoint the petitioner's daughter Akansha Srivastava on compassionate ground in place of her late father Maheshwari Prasad Srivastava in the office of the U.P. State Road Transport Corporation, Deoria on Class-III post or on any other post according to her academic qualification."
It is argued by the counsel for the petitioner that the husband of the petitioner namely Maheshwari Prasad Srivastava was appointed on the post of Khalasi (cleaner) in the office of the U.P. State Road Transport Corporation on 2.2.1973. Unfortunately he died on 31.12.2011 while working on the post of Khalasi. After his death now the petitioner is claiming for appointment of her daughter namely Akansha Srivastava who is the only issue of her father and mother, to appoint her on the aforesaid post under dying-in-harness rules. In this regard various representations were made by the petitioner but till date no decision has been taken on the same.
It is argued by Shri M.M. Sahai that competent authority will look into the grievances raised by the petitioner and pass appropriate order expeditiously.
Heard counsel for the parties and perused the record.
In view of above and without expressing any opinion on the merits of the case, the present petition is disposed of finally directing the Assistant Regional Manager, Deoria to look into the grievances raised by the petitioner and pass appropriate orders on same, most expeditiously and preferably within a period of three months from today.
Shri M.M. Sahai will communicate the copy of this order to the authorities concerned.
