Heard Sri P.S. Tripathi, Advocate holding brief of Sri H.S.N. Tripathi, learned counsel for the revisionist and learned A.G.A. for the State. No one is present on behalf of the opposite party no.2 even in revised call.
This criminal revision has been preferred by the revisionist against the order dated 04.06.1996 passed by learned Family Court Judge, Varanasi in Case No. 553 of 1995 (Smt. Usha Devi Vs. Suresh Ram), under Section 125 Cr.P.C., P.S. Adampur, District Varanasi, whereby application of the revisionist under Section 125 Cr.P.C. has been rejected. Record shows that this revision was filed in the year 1996, but no interim order in favour of the revisionist was granted. Revision has also not yet been admitted.
After having the arguments of learned counsel for the parties and perusing the record, I find that there is no manifest error or illegality in the order dated 04.06.1996 passed by learned Family Court Judge, Varanasi. Presumptions, observations and findings recorded by the learned Family Court under the facts, circumstances and material on record are fully sustainable.
In view of the above, no interference is required in the judgment and order dated 04.06.1996.
The revision lacks merit and is accordingly dismissed. Order Date :- 21.12.2018 Abhishek
