Heard learned counsel for the petitioners.
The prayer made is for a direction to the Tribunal to proceed and expedite the execution of the award made by the Tribunal in the present case which is arising out of a claim of the death of one Bhaskar Ojha. Execution Case No. 7 of 2018 is stated to be pending since long, the award having been made in the year 2013. It appears that the execution case was lodged at a belated stage as the appeal filed by the Insurance Company before this High Court remained pending without any interim orders as stated in paragraph no. 12 of the writ petition.
In view of this averments made in the writ petition that no orders staying the award has been passed in the appeal since the year 2013, it will be open to the Tribunal to proceed with the execution in accordance with law expeditiously preferably within three months from the date of production of certified copy of the order before him subject to any order being passed in the pending First Appeal From Order before this Court.
Disposed of.
