By order dated 30.8.2017 passed in Writ C No. 39394 of 2017 filed by the applicant, this Court directed Sub-Divisional Magistrate to pass appropriate orders on the complaint relating to encroachment upon chak road and a nali, after hearing the parties, within a period of six weeks from the date of production of a certified copy of the order.
On matter being taken up today, Sri P.K. Giri, learned Additional Chief Standing Counsel, on instructions, states that after enquiry it transpired that there is no encroachment over chak road. However, encroachment was found over nali and accordingly, proceedings under Section 68 of the U.P. Revenue Code, 2006 have been initiated against the person, who had made encroachment. The next date fixed in the said matter is 10.8.2018.
Since the opposite party has already made substantial compliance of the direction issued by the writ Court, therefore, this Court finds no good reason to proceed any further in the instant matter.
The contempt application is disposed of at this stage.
