Heard learned counsel for the parties.
This writ petition is filed challenging the proposed action of the respondents 2 and 3 in evicting the petitioner from the land to an extent of 488 sq. yards consisting of two rooms and a shed bearing door No. 13-1-1139/A/16 in Sy.No. 50 situated in Dilwargunj, Dhoolpet, Hyderabad.
Learned Government Pleader for Revenue appearing for the respondents, on instructions, submits that the petitioner has already filed as many as four suits being O.S.Nos. 2466, 2506, 2522 and 2743 of 2004 and all the said suits are pending before the 8th Senior Civil Judge, City Civil Court, Hyderabad. Entertainment of the writ petition parallel to the civil suits is not permissible on the face of it. Even otherwise, according to the instructions of the learned Government Pleader for Revenue, the subject land is recorded in Town Survey as Government grave yard. Hence the writ petition is not entertained and it is accordingly dismissed along with miscellaneous applications, if any. No order as to costs.
