Heard Sri Bharat Kishore Srivastava, learned counsel for the applicants and Sri Rammani Giri, learned counsel for O.P. No.2 This is an application filed under Section 482 Cr.P.C. seeking to set aside the order dated 19.02.2018 passed by 4th ACJM, Ghaziabad (Case No.1 of 2015), under Sections 498A, 323, 504, 506 I.P.C. and 3/4 D.P. Act, P.S. Mahila Thana, District Ghaziabad in Protest Petition No.215 of 2017 (O.P. Arya Vs. Sunny Singh & Ors.).
Earlier, the matter was referred to Mediation Centre for settlement. However, report of the Mediation Center dated 6.9.2019 indicates that parties could not reach to a settlement/agreement.
It is contended by learned counsel for the applicant that the matter has already been settled between the parties out side the Court and the settlement agreement dated 1.2.2019 is annexed along with compromise affidavit filed by O.P. No.2.
Since the matter had already been settled between the parties, the proceedings of the aforesaid case against the applicants is hereby quashed.
The application is allowed.
