Writ petition filed under Article 226 of the Constitution of India, praying this Court for issuance of Writ of Certiorarified Mandamus to call for the records relating to the letter dated 10.01.2017 of the second respondent and to quash the same and consequently to direct respondents to allow the petitioner to attend classes for the upcoming 4th semester and to condone his absence from 03.10.2016 to till date on medical ground so as to enable him to write the 4th semester exams.
For Petitioner : Mr.Raja Srinivas For Respondents : Mr.R.Gopinath, for R1 Fr.Xavier Arulraj, Senior counsel for Ms.A.Arul Mary, for R2 ORDER The petitioner has come up with the present writ petition challenging the order of the second respondent/College by which the petitioner was advised to take transfer certificate.
2. The petitioner is a student doing a two year course in MSW (Master of Social Welfare) in the second respondent/college for the academic year 2015- 2017. Due to an incident that took place on 03.10.2016, the petitioner's life was in danger and therefore, the college authorities advised the petitioner to take transfer certificate from the college. The said order is being challenged before this Court.
3. Heard, Mr.Raja Srinivas, learned counsel appearing for the petitioner, Mr.R.Gopinath, learned counsel appearing for the first respondent and Fr.Xavier Arulraj, learned Senior counsel appearing for the second respondent.
4. The learned Senior Counsel appearing for the second respondent would submit that pursuant to the direction of this Court, he had advised the second respondent/College to give a conduct certificate to the petitioner and also to arrange for admitting the petitioner in any one of the colleges in the city or in the suburban area. Accordingly, the second respondent college requested the first respondent to arrange for admitting the student, who in turn requested the Nazareth College of Arts and Science, Avadi to admit the petitioner, which had readily agreed to the request made by the first respondent and admit the petitioner in its institution.
5. In view of the above stated position, the writ petition is disposed of with a direction to the petitioner to get transfer certificate from the second respondent college and get admitted in Nazareth College of Arts and Science, Avadi. Further, this Court appreciates the active role played by Fr.Xavier Arulraj, learned Senior counsel appearing for the second respondent as well as the learned counsel for the petitioner for safeguarding the interest of the petitioner. Connected miscellaneous petitions are closed. No costs.
