T.V.Anuradha L.P.S.A vs State Of Kerala

High Court Of Kerala|20 December, 2014

JUDGMENT / ORDER

Heard the learned counsel for the petitioner and the learned Government Pleader for respondents 1 to 3, apart from perusing the record. Since the issue lies in a narrow compass, this Court proposes to dispose of the writ petition at the admission stage itself. 2. Briefly stated, the petitioner is said to be working without salary as LPSA in a substantive vacancy in a school under the management of the 4th respondent. As she has been working since 01.08.2009, the petitioner was included in Teachers' package. Apprehending that the authorities have already initiated action to remove her name from Teachers' package, the petitioner is said to have submitted Ext.P11 representation before the 1st respondent. Seeking its expeditious disposal, the petitioner filed the present writ petition.
3. The learned Government Pleader, on the other hand, has contended that the petitioner has not been appointed in a W.P.(C.) No. 35040/2014 -2-
substantive vacancy. He has further submitted that the petitioner's claim for approval was rejected by the authorities through Ext.P7 and later through Ext.P10 by the 1st respondent. In the face of Ext.P10, an order of rejection by the Government, the question of the 1st respondent entertaining another representation from the petitioner does not arise.
4. Be that as it may, at any rate, as could be seen from the record in Ext.P11, the petitioner has sought a relief against removing her name from the Teachers' package.
In the facts and circumstances, having regard to the respective submissions of the learned Counsel for the petitioner and the learned Government Pleader, this Court, without expressing any opinion on the merits of the matter, disposes of the writ petition with a direction to the 1st respondent to consider the petitioner's Ext.P11 representation in accordance with law, after affording an opportunity of hearing to the petitioner and pass appropriate orders thereon, as expeditiously as possible, at any rate, within four months from the date of receipt of a copy of this judgment.
