The petitioner herein is the respondent in O.P No.400/2013 before the Family Court, Muvattupuzha. It is a petition brought by her husband for declaration of title, and it is one of the many cases pending between the parties. She wants transfer of case to the Family Court, Thodupuzha. It is submitted that the marriage between the parties was in fact solemnized within the jurisdiction of Family Court, Thodupuzha, and a maintenance claim already stands disposed of by the Family Court, Thodupuzha. The request for transfer is not opposed by the other side. I feel that no prejudice or hardship will be caused to the other side if the case is transferred from Muvattupuzha to Thodupuzha.
Hence the petition is allowed. O.P No.400/2013 now pending before the Family Court, Muvattupuzha is ordered to be transferred to the Family Court, Thodupuzha. The learned Judge of the Family Court, Muvattupuzha will transmit records of the case to the other court without delay. Notice for appearance shall be given to the parties from the Family Court, Thodupuzha.
