JUDGMENT / ORDER

(Per : HONOURABLE MR.JUSTICE JAYANT PATEL) The present applications have been preferred for restoration of the First Appeals which came to be withdrawn earlier.
The controversy involved in the Misc. Civil Applications is such that at the time when Court considers the applications for restoration, this Bench may also be required to examine and hear the First Appeals itself simultaneously. As per the present roster, the business of First Appeal is not assigned to this Court and is with Court No.1.
Under the circumstances, in order to see that Misc. Civil Applications can simultaneously heard with the First Appeals, wherein, the merits of the First Appeals may also be considered, unless the present First Appeal No.2916 of 2010 and 2915 of 2010 are assigned to this Court, it may not be possible for this Court to decide the applications for restoration devoid of merit of First Appeals.
Hence, Office to place the matters before the Bench as may be ordered by the Hon'ble the Acting Chief Justice on administrative side.
