Heard Sri Niraj Tiwari, learned counsel for the petitioner and learned Standing Counsel for the respondents.
The petitioner has prayed for the following relief:
"Issue a writ, order of direction in the nature of mandamus commanding the respondent no. 5 Prescribed Authority/Deputy District Election Officer, District Banda to decide the election petition no. 853 of 2021 which computer case T202107110400853 Tulsidas Vs Vijay Kumar and others regarding the recounting of total casted votes (2278 at Booth No. 1192, 193, 194, 195, and 196) and further be pleased to cancel the result and declaration of the respondent no. 6 as Pradhan of the village and also be please enquire those valate paper which has been declared unvalid by the Returning Officer thereafter declare the petitioner as Pradhan of village Pukari Block and Tehsil Naraini District Banda."
There is no good cause for this Court to prioritise the hearing of an election petition filed in the year 2021.
Faced with this the learned counsel for the petitioner seeks leave to approach the tribunal.
It is open to the petitioner to move an application for expediting the hearing of the election petition before the election tribunal.
In case such application is moved, the same shall be decided by the election tribunal in accordance with law and as per its roster.
The writ petition is disposed of.
