This petition had earlier come up before the Court on 06.12.2018, when the following order was passed:-
"Although, none has appeared to press this writ petition, this Court however finds blatant irregularities, on record.
First, in proceedings for allotment of chaks, plot no. 750/1, which was reserved for a public purpose has been allotted in the chak of the petitioner in chak allotment proceedings.
It is also clear from the record that plot no. 750/1 is not the original holding of the petitioner and, therefore, he could not have objected to its reservation for a public purpose, in the statement of principles.
Secondly, the petitioner claims to be an allottee of either 3.8 hectares or 3.8 acres of land. This Court fails to understand as to how such a huge tract of land could be allotted on lease, if at all.
Learned counsel for the Gaon Sabha to obtain clear instructions in this regard.
Learned Standing Counsel shall intimate the Collector, Lalitpur seeking instructions in this regard.
Put up as fresh on 18.12.2018."
It is clear that the order aforesaid records that none has appeared to press this writ petition.
Today on the matter being called out in the revised call, none has appeared for the petitioner.
Learned Standing Counsel states that he has instructions in the matter.
However, counsel for the petitioner has repeatedly remained absent, which is led the wastage in time of the Court.
This writ petition is hereby dismissed with cost of Rs. 1 lakhs to be recovered jointly from counsel for the petitioner and the petitioner himself as arrears of land revenue, if the same is not deposited within the next ten days from today.
