ORDER:
This contempt case is filed alleging willful disobedience of order dated 23.12.2013 in W.P.No.37702 of 2013.
In obedience to the direction of this Court, the contemnor is personally present. He has also filed a counter-affidavit. In his counter-affidavit, while pleading lack of knowledge of the above- mentioned order, the contemnor has stated that as the land is a part of tank poramboke and the petitioner started raising construction, he has only stopped the construction and that he has not interfered with the petitioner’s possession of the property.
The learned Government Pleader for Revenue (Andhra Area) submitted that as per the liberty given by this Court in the above-mentioned order, the respondent will initiate appropriate proceedings for the eviction of the petitioner and that till such proceedings are initiated and appropriate order is passed, the respondent will not interfere with the petitioner’s possession.
The above submission of the learned Government Pleader is placed on record.
The contempt case is accordingly closed and the contemnor is discharged from the contempt proceedings.
