Respondent This Criminal Petition is filed under Section 439 of Cr.P.C. praying to enlarge the petitioner on bail in Cr.No.292/2016 of Pulakeshinagar Police Station, Bengaluru City for the offences P/U/S 344, 367, 323, 504, 506, 326, 307, 420, 370, 384 r/w 34 of IPC.
This Criminal Petition coming on for orders this day, the Court made the following:
ORDER The petitioner (Accused No.6) along with the co-accused is charge sheeted in respect of the offences punishable under Sections 344, 367, 323, 504, 506, 326, 307, 420, 370, 384 read with Section 34 of IPC by the respondent-police in their Crime No. 292/2016.
2. The gist of the allegation is that the petitioner is a priest in a temple where the victim/CW1 used to very often visit to offer prayer to the deity. The petitioner introduced CW1 to transgenders. Further, on the complaint of the mother of the victim, he was secured. Subsequently, the accused forcibly amputated the penis of victim, treated him inhumanly etc.,.
3. Heard the learned counsel for the petitioner and the learned HCGP for the respondent – State.
4. The petitioner is a person aged sixty years, said to be the permanent resident of the cause title address and a family person. Since the investigation is complete, having regard to the definite role attributed against him in the alleged offence, there is no impediment to allow the petition.
Accordingly, petition is allowed. Petitioner is enlarged on bail on his executing a self bond in a sum of Rs. 5,00,000/- with two local sureties for the likesum. The surety shall furnish/produce their Adhaar Card, original title deeds pertaining to their properties before the concerned court for perusal.
Petitioner shall attend court on all the hearing dates regularly.
Petitioner shall not leave the jurisdiction of the concerned Sessions court till disposal of the case.
He shall not, for whatever reason, approach the co- accused or their supporters or prosecution witnesses directly or indirectly.
He shall not tamper prosecution witness.
He shall not indulge himself in any criminal/illegal activities.
