Heard the counsel for the petitioner and Sri Brajesh Shukla, the counsel for respondent nos. 12, 13, 15, 16, 17 and 4.
The grievance of the petitioner against the order dated 10.7.2019 challenged in the present writ petition is that the petitioner had purchased the disputed plots from respondent no. 4 through a sale deed dated 6.6.2016, i.e., after the order passed by the Settlement Officer of Consolidation challenged in revision but the petitioner was not impleaded in the revision filed by respondent no. 3 and the order dated 10.7.2019 has been passed without giving any opportunity of hearing to the petitioner and without issuing any notice to him.
On the averments made in the writ petition, the petitioner has the remedy to file a recall application for recall of the order dated 10.7.2019 before the Deputy Director of Consolidation as the order was passed adversely affecting the petitioner. In case, the petitioner files a recall application within one month from today, the said recall application shall be decided by the Deputy Director of Consolidation, Bijnor, i.e., respondent no. 1 within three months from the filing of the same.
Till the decision by the Deputy Director of Consolidation on the recall application filed by the petitioner, parties shall maintain status-quo regarding the disputed plots.
With the aforesaid direction, the writ petition is disposed of.
