List has been revised. Nobody is present for the petitioner. Learned Standing Counsel is present for the respondent.
The applicant is before this Court for a direction to initiate contempt proceeding against the opposite parties for willful disobedience of the order dated 25.8.2017 passed in Writ Petition No.38662 of 2017 (Tufail Ahmad Vs. State of U.P. and Others). The operative portion of the order is reproduced hereinbelow:-
"The writ petition is disposed of with the direction to respondent No.2 to consider the claim of the petitioner as to why the petitioner has been ignored whereas his juniors have been given the promotional pay scale and pass appropriate orders in accordance with law, as far as possible, within a period of four months from the date a certified copy of this order is presented before it."
It is argued by learned Standing Counsel that in compliance of the order of this court, a decision has already been taken on 24.12.2018 by the opposite party, a copy of the said order is appended as annexure 1 to the affidavit of compliance and no cause of action would further survived and prays for dismissal of the present contempt application.
Since the order of the writ court has already been complied with, therefore, no further order is required.
Accordingly, the present contempt application is dismissed.
In case, the applicant is still aggrieved with the decision of the opposite party, he has liberty to challenge the same before appropriate forum.
