Learned counsel for the appellants has urged that the Tribunal has committed an error in directing the appellants to pay the same salary to the private institutions which are being paid to the Government aided institutions. According to the learned counsel for the appellants, this is not permissible. In this regard, he has placed reliance on the decision of the Apex Court in Sushmita Basu vs. Ballygunge Siksha Samity 2006(7) SCC 680.

Till 23.1.2013, effect and operation of the order dated Page 1 of 2 C/LPA/1152/2012 ORDER 31.7.2012 passed by the learned Single Judge in Special Civil Application No.6076 of 2011 and 6077 of 2011 as well as the order of the Gujarat Primary Education Tribunal dated 11.1.2011 and 12.1.2011 shall remain stayed. Direct service is permitted.
