JUDGMENT / ORDER

Both the learned Senior Advocate, Mr.Shalin N.Mehta for Mr.Hemang M.Shah, learned advocate for the appellant and learned counsel, Mr.A.J.Patel for Mr.Ravindra Shah, learned advocate for the respondent have made a joint statement at the bar that if suit is directed to be decided expeditiously, they would not invite for reasoned order.
In view of the above joint statement, without deciding the matter on merits, learned Principal Judge, City Civil Court, Ahmedabad, is directed to dispose of Civil Suit (CCC) No.550 of 2011 by deciding it on its own merits including the point of jurisdiction in light of the evidence adduced and submissions canvassed by the learned advocates appearing for the respective parties, as expeditiously as possible preferably within two years from the date of receipt of copy of this order, in accordance with law and without being influenced by the order passed below injunction application as well as this order.
With the above direction and observation, this Appeal From Order and Civil Application stand disposed of.
