JUDGMENT / ORDER

Petitioner is the husband of the first respondent. First respondent filed a complaint against her husband alleging offences punishable under Sections 406 and 498A read with Section 34 of Indian Penal Code. Vadanappilly Police registered Crime No.15 of 2011. 2. Heard learned counsel for the petitioner/accused and the de facto complainant.
3. It is submitted that the parties have settled the matter out of court. Wife filed an affidavit stating that she has no subsisting grievance against the petitioner. They have approached the Family Court for passing a decree of divorce also.
4. Taking into consideration all facts and circumstances, I find that further prosecution of the case will not result in any benefit to the parties. Therefore, the petition is allowed and Annexure-II final report in Crime No.15/2011 of Vadanappilly Crl.MC.1739/14 2 Police Station pending before the learned Judicial First Class Magistrate, Chavakkad is hereby quashed.
Criminal M.C is disposed of as above.
