Heard learned counsel for the petitioner.
Challenge in the writ petition is to an order passed by the Tehsildar in proceedings under Section 67 of the U.P. Revenue Code, 2006.
It is stated that the order is ex-parte. In case, the order passed ex-parte, the petitioner should have file a recall application or else he has a statutory alternative remedy. The order is appealable under sub-section 5 of Section 67 of the Act.
Petitioner has not invoked these statutory alternative remedies and has come up before this Court directly.
The writ petition, under the circumstances, is entirely misconceived and is dismissed with cost.
