Heard Mr. Nikhil Mishra, counsel for the petitioner and Mr. Ashish Mishra, counsel for the respondent no.1.
In view of the order proposed to be passed, notices need not go to the private respondents.
The petitioner is before this Court for a direction to respondent no.1/Civil Judge (S.D.)/A.C.J.M., Court No.3, Prayagraj to decide the Original Suit No.1342 of 2015 within stipulated period.
It is argued by learned counsel for the petitioner that inspite of the fact that earlier directions were issued by this Court at least for two occasions but till date no final decision has been taken in the matter.
On the other hand it is argued by Mr. Ashish Mishra, counsel for the respondent no.1 that court below will decide the aforesaid suit most expeditiously and if possible on day to day basis.
Considering the facts and circumstances of the case, without expressing any opinion on the merits of the issue, the present petition stands disposed of finally with a direction to the concerned court below to consider and decide the aforesaid suit in accordance with law most expeditiously, if possible on day to day basis not later than three months from today after giving opportunity of hearing to the parties concerned.
It is made clear that parties may not seek unnecessary adjournments.
