Heard Shri Pradeep Kumar Singh, learned counsel for the petitioner and Shri Pranjal Mehrotra, learned counsel for respondent nos. 2 & 3.
This writ petition is, essentially, filed challenging the communication dated 01.09.2020 passed by respondent no. 3; whereby, the petitioner, a contractor, was debarred from participation in future tenders for a period of two years on account of its alleged involvement in nefarious activities. The petitioner has also prayed for clearance of certain outstanding bills pending before the authorities concerned for services rendered by it.
Shri Mehrotra submits, on instructions, that the communication dated 01.09.2020 has been withdrawn by the authority concerned and substituted by an order of warning dated 24.12.2020.
We have no reason to disbelieve his statement.
In so far as first relief is concerned, grievance of the petitioner already stands redressed and as far as second relief is concerned, it would be in the fitness of things that if the petitioner approaches the competent authority for clearance of outstanding dues, Shri Mehrotra has assured that needful shall be done without further delay.
