Heard Mr. Puneet Bhadauria, learned counsel for the petitioner and Mr. A.K. Goyal, learned Additional Chief Standing Counsel for the respondents-State.
The grievance of the petitioner is that the private respondents have raised illegal construction over public path, as a result of which great inconvenience is being caused to public at large.
Having regard to this grievance, it is open to the petitioner to invoke the provisions of Section 133 of the Code of Criminal Procedure, 1973. We, accordingly, leave it open to the petitioner to move an appropriate application before the competent authority for an expeditious decision thereon.
The petition is accordingly disposed of. There shall be no order as to costs.
