Heard learned counsel for the petitioner, learned Standing Counsel for the respondent nos.1 and 2 and Sri Suresh Singh, learned counsel appearing for respondent no. 3.
It is stated that though the petitioner has executed the sale-deed dated 30.12.2013 in favour of Yamuna Express-way, but in view of the Government Order dated 14 September, 2016 which provides benefits even to those persons, who had executed sale-deed in favour of the Authority, the petitioner is also entitled to the benefits of the Government Order.
Learned counsel for the respondents states that a decision would be taken in the matter by the Authority expeditiously, provided the petitioner approaches the said authority.
In the facts and circumstances, we dispose of the writ petition with a direction to the petitioner to file a representation before respondent no. 3 raising all his grievances, which have been raised by him in this writ petition within a period of three weeks from today and in case, any such representation is made, respondent no. 3 shall consider and decide the same by a reasoned and speaking order in accordance with law, taking into consideration, the Government Order dated 14 September, 2016 within a period of two months from the date of receipt of the representation.
It is made clear that the Court has not adjudicated upon the claim of the petitioner on merits and it is for the Authority to take a decision in accordance with law.
