The instant contempt application has been filed for alleged violation of direction issued by the writ Court on 21.12.2017 in Writ C No. 61809 of 2017 directing the Sub-Divisional Magistrate, Phoolpur, district Allahabad to decide Case No. Nil of 2016 under Section 41 of the U.P.Z.A. & L.R. Act, 1950, expeditiously, preferably within two months from the date of production of certified copy of the order.
On matter being taken up today, Sri P.K. Giri, learned Additional Chief Standing Counsel, on instructions, states that in pursuance of the direction issued by this Court, the opposite party issued notice to the parties on 5.7.2018 fixing 17.8.2018. He assures the Court that the opposite party will make all efforts to conclude the proceedings expeditiously.
Having regard to the stand taken by the opposite party and the assurance being extended on his behalf, the instant contempt application is disposed of at this stage by providing that the opposite party shall ensure that the proceedings are concluded within next two months, failing which it shall be open to the applicant to approach this Court again by way of a fresh petition.
