Sri K.R.Singh, learned Additional Chief Standing Counsel apprised to the Court that the Writ Court's order dated 28.11.2018 was subject to challenge before the Division Bench in Special Appeal Defective No. 606 of 2019, which was dismissed vide order dated 11.7.2019. Thereafter, the Authority has proceeded to grant the relief to the applicant as mandated by the Writ Court and consequently, a letter/order dated 18.7.2019 was issued to the Additional Director, Treasury and Pension, Varanasi for issuing pension payment order to the applicant. Pursuant thereto the Additional Director issued the necessary pension payment order dated 26.7.2019 for the payment of pension and gratuity to the applicant. An affidavit of compliance in this regard filed on behalf of the opposite party no. 3 is taken on record.
In the facts and circumstances, the Court is of the opinion that substantial compliance has been made in the matter and the cause for filing of the contempt application no more survives. Needless to say, in response to the pension payment order dated 18.7.2019, the Authority would ensure entire dues must be paid to the applicant within reasonable time.
Consequently, the present contempt application stands disposed of. Notice, if any, stands discharged.
