Heard learned counsel for the parties and perused the record.
This writ petition has been filed, inter alia, for the following reliefs :-
(i) Issue, a writ, order or direction in the nature of mandamus, directing the respondents particularly respondent no.2 not to permit any one to raise any construction regarding boundary wall of civil court over the land of the petitioner particularly on the land of the petitioner particularly on the land just beside East of the court of Civil Judge (Junior Division) Chakia, Chandauli.
A perusal of the record shows that the petitioner is having a dispute with the private parties over the land in question. Petitioner in substance is seeking a relief against private parties. Since, the dispute is between the private parties of civil nature, it cannot be adjudicated upon by this court in exercise of the powers conferred under Article 226 of the Constitution of India.
In view of the above, we do not see any justification to interfere in the matter. However, it is open to the petitioner to seek appropriate remedy before appropriate forum in accordance with law.
With aforesaid observation, this writ petition is disposed of finally.
